L.A. Tenants Sue Over ADU Conversions of Parking Spaces
  • Landlords in Hollywood, Koreatown, Silver Lake and Pico Union are turning garages and parking lots into ADUs, and tenants are now taking them to court, saying parking is part of their leases.
  • SB 1211, in force since January 2025, bars local governments from demanding replacement parking for ADU conversions, but advocates say it doesn’t address spaces already written into rental agreements.
  • A judge paused a Hollywood project that would turn 20 spaces into nine units, a sign that state ADU incentives may not shield owners from lease and rent-stabilization claims.
Key Takeaways

State housing policy is colliding with tenant leases in Los Angeles. Landlords who convert apartment parking into accessory dwelling units are facing tenant lawsuits, The Real Deal reports, citing the Los Angeles Times.

One Hollywood project has already been paused by a judge.

What the Law Allows

SB 1211 has applied since January 2025 and opened more ADU options on multifamily lots, including garage and other non-habitable conversions. It also prohibits cities from demanding substitute parking.

Owners are using it across dense neighborhoods such as Hollywood, Koreatown, Silver Lake and Pico Union.

Tenants Fight Back

Tenant advocates argue the statute is silent on spaces already included in leases and covers only vacant stalls. Curb parking is hard to find, and numerous buildings are rent-stabilized.

One resident near the Sunset Strip described parking to the paper as a lifeline. Koreatown tenants staged protests over a conversion last year.

The Court Fights

In Hollywood, residents of a rent-stabilized building challenged city permits that turn 20 stalls into nine units. A county Superior Court judge froze the work in May, and the suit continues.

The tenants say parking comes with their units under the rent stabilization ordinance, so removing it unlawfully alters their leases. In filings, the city attorney’s office argued that local renter protections can’t block what state law mandates.

A second suit in Silver Lake comes from an 83-year-old tenant with mobility limits a resident there since 1995. She says losing her garage space breaks disability and fair housing rules.

Zoom Out

ADUs are already shifting the L.A. rental market. Our brief on L.A. County rents showed median asking rent dropping 3.6% to $2,554 in Q3, per Realtor.com, with smaller units falling fastest, partly tied to new ADU supply.

Costs temper the upside. Our brief on NYC’s ADU push cited $200K to $550K per unit, and noted that about one in four new California housing structures last year was an ADU.

Why It Matters

Owners eyeing conversions need to read leases and rent-stabilization rules, not just state law. A stalled project means holding costs and legal fees.

For lenders and buyers underwriting rent-stabilized buildings, parking is now a possible legal claim as well as an amenity.

The fight also exposes a gap in the statute. If advocates are right that it is silent on parking already written into leases, courts will have to fill it in, one building at a time.

What’s Next

The Hollywood case is still pending. No court has yet ruled on whether state ADU law overrides parking rights in existing leases.
